FLOODPLAIN MANAGEMENT ORDINANCE
LEGAL AUTHORITY: CHAPTER 364, CODE 0F
This ordinance is designed
to meet the minimum requirements for acceptance in the National Flood Insurance
Program for cities which have a Flood Hazard Boundary Map (FHBM) issued by the
Federal Emergency Management Agency (FEMA), but have not been provided with
detailed floodplain information.
Specific floodplain
management criteria are set forth in
Section 60.3(b) of the rules and regulations as published in the
This ordinance is a
special-purpose ordinance established under authority of Chapter 364 of the
Iowa Code (City home rule).
This ordinance
establishes a development permit system which requires a permit for all
development within the Special Flood Hazard Area (i.e., Zone A or the shaded
area as shown on the community's Flood Hazard Boundary Map). Specific performance standards for
construction within that area are given in Section
The Department of Natural Resources (Section 455B.275,
Code of Iowa) must also approve most floodplain construction, so applicants for
