ORDINANCE #2-2008

 

AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF SPRINGVILLE, IOWA, 1997, SUBSQUENTLY AMENDED BY ORDINANCE #2-2004, BY AMENDING PROVISIONS PERTAINING TO SANITARY SEWER RATES AND CHARGES.

CHAPTER 3 - LIQUID WASTES

ARTICLE 10 - USER CHARGE SYSTEM

 

Section 1.  Section modified.  Section 3-3.1008 – USER CHARGES, shall be amended as follows: Each and every lot, parcel of real estate, building or premises situated within the corporate limits of the City or that in any way uses or discharges sanitary sewage, industrial waste, water or other liquids, either directly or indirectly in the sewage system of the City, shall pay a monthly service charge to the City as prescribed under Section 3-3.1012 Service Charges.  The sewer use charge means that portion of the total wastewater service charge that is levied in a proportional and adequate manner for the cost of, operation, maintenance and replacement of the wastewater treatment works.

 

Minimum Charges.  A minimum sewer charge (known as the service access charge) shall be set for each monthly period or fraction thereof for each water meter installed on any lot, parcel of real estate, building or premises situated within the corporate limits of the City provided that all or part of the water measured by meter discharges in to the sanitary sewer system of the City.  Said charge shall be established under Section 3-3.1012 Service Charges. The minimum charge will cover the initial 2,000 gallons of water and water service attributable to the customer for the property served.  The minimum sewage service charge shall also apply to any industrial firm, institution and public or private corporation discharging wastewater or other liquids into the sanitary sewer system of the City, although no water meter is installed upon said premises.  

 

Section 2.  Section modified.  Section 3-3.1012 – SERVICE CHARGES, shall be amended as follows: There shall be and there are hereby established sewer service charges for the use of and for the service supplied by the municipal sanitary sewer utility based upon the amount and rate of water consumed as follows:

 

            AMOUNT                                             SEWER CHARGES

 

            First 2,000 gallons or lesser        $10.00 per month

            amount per month                     (minimum monthly bill)

 

            All over 2,000 gallons                 $4.00/1,000 gallons of water usage

            per month                                 (service charge)

 

Section 3.  REPEALER.  All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.

 

Section 4.  SEVERABILITY CLAUSE.  If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional.

 

Section 5.  WHEN EFFECTIVE.  This ordinance shall be in effect September 1, 2008.
